Since there are many discussions on the role of morality in jurisprubence and law, the author tries to make a comparison between jurisprudence and law with reference to their conceptual and judgemental origions so that to explore the relation between jurisprudence and law synoptically.The issues pertaining to the philosophy of law including the place of morality in laws or their relation have always been the matter of discussion. This articl will deal with this issue in brief. There are differences of views among people concernign the morality and this standards. Yet these differences pertains to practical field rather than the nature of principles and moral norms

Imam Khomeini, as the charismatic leader of Islamic Revolution, had a multifarious personality. He was the religious authority, a jurisprudent, Gnostic, philosopher, theosophist and politician who led the Islamic Revolution to victory. During the lifetime of Imam Khomeini, which covers about one century of Iran's contemporary history, there were a number of other religious authorities and scholars who had a different political approach.
The main question of the present paper is: How a Gnostic or a religious authority engages in such large-scale political activities? Has his approach any root in the past interactions and developments? The present paper is an attempt to study the biography of Imam Khomeini from his childhood to the 1941 coup. Also the impact of major political developments on the formation of Imam's political thought will be studied.

The intellectual, cultural and political lacunas of the present century and the necessity of filing them up entails that the truth of the creation is shown to mankind on the basis of a rational approach so that they will be able to fulfill their spiritual and metal needs in the light of this knowledge. Also it should enable human beings to form a government in which man is the highest manifestation of God who has dignity and honor. In such a government the spirit of spirituality, justice, peace, and equality is breathed into the body of society. The citizens pay a significant constructive role and their votes play a decisive role in the determination of their fate. In our time, Imam Khomeini revived such an identity. The present paper is an attempt to study the role of Imam Khomeini in the revival of such a cultural identity.

The Chapter 3 of the Constitution of the Islamic Republic of Iran discusses the fundamental rights of the nation in 24 articles. These rights can be categorized on the basis of the following three pivots: equality, security and freedom.
In the present paper the three said concepts are discussed conceptually and then they are analyzed from jurisprudential and legal points of view as given in the Constitution of the Islamic Republic of Iran.

Literature means the culture which is in opposition to the status quo and literature of resistance means a culture and idea that defends the truth and rejects falsehood. The main thrust of the present paper is to discuss the basics of Imam's literature of resistance. The present research focuses on four subjects: other, bases, factors, and obstacles of Imam's literature of resistance.
Regarding the first subject, Imam's literature is in confrontation with the literature of the East and West. With regard to the second subject, the bases of the literature of mundane uprising and resistance which is based on worldly reason and its relations with the divine uprising and resistance, which is based on the divine commandments are discussed. Regarding the third subject, the literature of resistance of Imam is known by such features as faith in God, self-confidence, awakening, etc. The fourth subject emphasizes on the literature of resistance along with the literature of uprising. The literature of uprising rejects the literature of the status quo, which is an obstacle in the way of the literature of uprising. The main obstacles of the literature of uprising are discussed in the present article

Political Discourse of Imam Khomeini and Rival Discourses

The political atmospheres are always replete with fluid signifiers. Generally the political discourses are formed to signify these signifiers. Hence we always observe rival discourses. These discourses try to articulate the fluid signifiers within their own identity. The outcome is discursive rivalry which will not last long and finally one discourse will becom the hegemonic one. After 1941 Iran witnessed a discursive rivalry between few political discourses. These discourses were trying to articulate such fluid signifiers as progress, development, freedom and democracy, social justice, and rejection of colonial domination within the framework of their identity. One of these discourses was that of the Islamic government which was led by Imam Khomeini. In this rivalry the discourse of Imam Khomeini finally became the hegemonic discourse. The present article is an attempt to discuss the reasons for this discourse to become hegemonic.
