عقد ازدواج مهم ترین پیمانی است که هر فرد در زندگی خویش منعقد میسازد. از این رو نسبت به عقود دیگر از ویژگیهایی برخوردار است. فریب و نیرنگ در هر جا و در هر قراردادی زشت و ناپسند است، و در چنین پیمان مقدسیزشتتر به نظر میرسد. با این وجود چنین عملی مورد توجه قانونگذار قرار نگرفته است. حقوقدانان عقیده دارند ماده۱۱۲۸قانون مدنی که ناظر بر اوصاف مورد نظر طرفین است، مورد تدلیس را هم دربرمیگیرد. این پژوهش با هدف بیان خلأ قانونی در باب تدلیس در امر ازدواج صورت گرفته است. با مراجعه به منابع فقهی و حقوقی بهدست میآید که این ماده قانونی پاسخگوی تمام موارد تدلیس در امر ازدواج نیست. چراکه تدلیس همواره بر مبنای عدم صفت مطلوب نیست، و دیگر آنکه حق فسخ به تنهایی موجب احقاق حق فرد فریب خورده نیست، ضمن اینکه در مواردی فسخ ازدواج نه تنها مشکل گشا نیست بلکه مشکلی بر مشکلات میافزاید.
The marriage contract is the most important contract that an individual concludes in his/her life. Hence, compared to other contracts, it has its specific characteristics. Guile and fraud is undesirable and uninvited in every contract, but it is more objectionable in such a sacred contract. Despite this fact, such a fraud has not drawn the due attention of the legislator. Lawyers argue that Article1128 of the Civil Code that covers the attributes of the two sides covers the issue of fraudulence as well. The focus of this research is the legal lacuna about fraudulence in marriage. A review of the legal and jurisprudential sources indicates that Article 1128 does not fully cover all cases of fraudulence in marriage. In fact, fraudulence does not always refer to the absence of a desirable attribute; moreover, the right to rescind a contract alone would not lead to the vindication of the rights of the deceived person. In addition, the abrogation of the marriage contract not only does not solve any problem but adds to the existing problems.
