در این مقاله استصحاب کلی از دیدگاه دو اصولی معاصر، امام خمینی و مرحوم میرزا حسن بجنوردی، مقایسه میشود. استصحاب کلی استصحاب مفهومی است که قابل صدق بر افراد کثیر است که بر مبنای مشهور اصولیین به سه نوع تقسیم میشود. امام خمینی استصحاب را در کلی نوع اول و کلی نوع دوم جاری میدانند. ایشان اشکال مهم وارد بر کلی نوع دوم را با قول به وحدت عرفیه پاسخ داده و سپس با بیان یک تفصیل که به اعتبار چگونگی لحاظ عرف نسبت به ویژگیهای فردی یا قدر مشترک افراد است، کلی نوع سوم را تبیین میکنند. از دیدگاه ایشان در کلی نوع سوم اگر عرف، ویژگیهای شخصی را مورد توجه قرار داده باشد، استصحاب جاری نیست ولی اگر ملحوظ عرف، قدر جامع افراد باشد، استصحاب جریان دارد. مرحوم میرزا حسن بجنوردی نیز جریان استصحاب را در کلی نوع اول و نوع دوم بلامانع دانسته و با قول به وحدت سنخیة موجود بین قضیة مورد یقین و قضیة مورد شک، اشکال اصلی وارد بر کلی نوع دوم را پاسخ میدهند. در کلی نوع سوم نیز با بیان اینکه ملاک، وحدت عرفیه است، تنها در صورتی که مراتب مشککه وجود داشته باشد استصحاب را جاری میدانند.
The present articleis a comparative study of the issue of Istishab (authorizing the previous state)from the viewpoints of two contemporary usuli jurisprudents, Imam Khomeini andMirza Hassan Bojnourdi. The general Istishab is conceptual Istishab which canbe applied to several people and is divided into three kinds according to theprinciples of jurisprudence. Imam Khomeini maintains that Istis-hab is appliedin the first and second general kinds. The Imam has answered the questionsregarding the second general kind by relying on the argument of advocates ofcommon sense and then has explained the third kind by elucidating the way ofconsidering common sense in individual characteristics or commonality ofindividuals. In his viewpoint, with regard to the third general kind, if commonsense has taken individual characteristics into consideration, Istishab is notapplied, but if the commonality of individuals is taken into consideration assubject of common sense, then Istishab is applied. The late Mirza HassanBojnourdi allows application of Istishab in the first and second general kindsand provides his answer to second kind by relying on the unity of nature of thedefinite issue and the issue under question. With regard to the third generalkind, he argues that the criterion is unity of the advocates of common senseand hence, Istishab can be applied only when there are uncertain issues
