According to jurists and lawyers, although the existence of emergency conditions undermines the consent of the parties to the contract, it does not damage the validity of the contract. But if the same emergency condition is abused and an unfair contract is imposed on the helpless party, such an agreement is not valid. Due to the lack of clear reference in the law, the lawmakers – in this case lawyers and jurists – have offered different guarantees for the nullification of such a contract which include nullification, right to abrogate, ineffectiveness, and adjustment. Although most of the Imamiyah jurisprudents advocate the validity of such contracts, some jurisprudents have proposed their nullification with regard to an amount above the equal price, but other jurisprudents have opposed it. Referring to the Rule of Hardship and Necessity, Imam Khomeini considers an amount above the equal price as invalid. This view which is somehow modification of the contact would guarantee the rights of the helpless person and at the same time is not open to the criticisms leveled against other viewpoints.}, keywords = {Emergency,compulsion,abuse of emergency,Imam Khomeini,Validity,nullification}, title_fa = {سوء استفاده از اضطرار با رویکردی بر اندیشه فقهی امام خمینی(ره)}, abstract_fa = {امروزه اعمال فشار در انعقاد قراردادها به صورت اکراه فیزیکی و اعمال خشونت کمتر به چشم می‌خورد، ولی به دلایل مختلف درونی و بیرونی، رضایت افراد در انعقاد قرارداد مخدوش می‌گردد. به عقیده حقوق‌دانان وجود شرایط اضطراری در انعقاد قرارداد، علی‌رغم اینکه رضای فرد به انجام معامله را مخدوش می‌سازد، به صحت قرارداد آسیبی وارد نمی‌آورد؛ ولی اگر از همین شرایط اضطراری سوء استفاده گردد و قراردادی غیرعادلانه بر مضطر تحمیل شود، این قرارداد، قابل حمایت نیست. با توجه به سکوت قانونگذار ما در این مورد، حقوق‌دانان ضمانت اجرا‌های مختلفی از جمله بطلان، حق فسخ، عدم نفوذ و قابلیت تعدیل یا ابطال قرارداد را برای این نوع قراردادها پیشنهاد کرده‌اند. در فقه امامیه نیز هرچند نظر مشهور بر صحت این نوع قراردادها تأکید دارد، ولی برخی فقها بطلان قرارداد در خصوص مبلغ زاید بر ثمن‌المثل را پیشنهاد کرده‌اند که با مخالفت سایر فقها رو به رو شده است. امام خمینی با استناد به قاعده نفی عسر و حرج، این گونه قراردادها را زمانی که به ایجاد عسر و حرج منتهی می‌گردد، در خصوص میزان زاید بر ثمن المثل باطل دانسته‌اند. این نظر که به نوعی تعدیل قرارداد به شمار می‌رود، ضمن اینکه به سایر انتقادات وارد بر نظریات مشابه پاسخ می‌دهد، می‌تواند به خوبی حقوق شخص مضطر را تأمین نماید.}, keywords_fa = {اضطرار,اکراه,سوء استفاده از اضطرار,امام خمینی(ره),صحت,بطلان}, url = {https://matin.ri-khomeini.ac.ir/article_61906.html}, eprint = {https://matin.ri-khomeini.ac.ir/article_61906_e3d187b2f89c0c02cfe9a16d57830f5b.pdf} }
