Journal Article 2018 04 10 Article 1133 of the Civil Code of the I. R. of Iran has given the right of divorce to men. A contemplation into the right of divorce for men is not affirmative of its legal nature, but also it shows strains of court verdict. Therefore, since the hypothesis may result in a change in the family rights, it requires careful review of the authentic sources. To that end, the two concepts of “right” and “verdict” must be first defined to make it clear that, first, what divorce would be like in either of the cases; and secondly, on what bases are the jurists’ theories regarding this debate. Each reason will be then analyzed and finally the principles governing the family will be presented based on the Holy Quran words and Imam Khomeini’s views on the issue to clarify the degree of divergence between the rightful theory and other views. Finally, it is necessary to present the results in the form of proposals to the legislature, apparently with an option to withdraw the above-said law. This paper has used a descriptive-analytical method and contains in its approach jurisprudential depth along with innovation in reasoning. <strong>:</strong> لسان ماده 1133 قانون مدنی گویای ماهیت حقی طلاق به نفع مردان است، این مهم در حالی است که تفحص در بطن آن نه‌تنها مثبت ماهیت حقی نیست بلکه سویه‌های حکمی‌بودن آن‌ را به دست‌ می‌دهد. بنابراین ازآن‌رو که نتیجه این فرضیه متضمن تغییر‌ عمیقی در حقوق خانواده است نیازمند غوری دقیق در منابع ‌اصیل است. بدین منظور بایسته است دو مفهوم «حق و حکم» مورد تعریف واقع‌شوند و سپس بیان گردد که اولاً طلاق در قالب هریک از آن‌ دو چه ساحتی می‌یابد و ثانیاً نظرات فقها پیرامون این بحث بر چه عللی استوار ‌است. سپس به نقد هر‌یک از ادله پرداخته ‌می‌شود و در آخر نیز اصول حاکم بر خانواده از منظر قرآن کریم و آرای امام خمینی در این باب ارائه ‌می‌گردد تا میزان تعارض نظریه حقیه با آنان روشن گردد. درنهایت نیز ضروری است تأثیرات این نتایج در قالب پیشنهاد‌هایی به مقنن ارائه شود که به ‌نظر‌می‌رسد در رأس آن حذف ماده مذکور قرار گیرد. لازم به‌ ذکراست که روش به کار گرفته‌شده در پژوهش روبرو توصیفی-تحلیلی بوده و در نوع نگاه خود دارای عمق فقهی بسیار توأم با نوآوری در استنباط است. https://matin.ri-khomeini.ac.ir/article_126893_5d55f6a50955c86eefea6097a669efdf.pdf
