Journal Article 2018 11 12 Freedom of speech, based on inherent human dignity and according to his individual independence, is an immanent value. Although the right of freedom of speech has been recognized as a civil and political right in civil rights system and in pro-democracy debates, a second glance at its extensive concept, including written, oral and artistic creations, places it among effective factors of cultural rights. The majority of human rights and freedoms are either included under cultural rights or there is a need for cultural rights to realize them accurately and effectively. The principal question of this study concerns analysis of the relationship between freedom of speech and cultural rights. Any access to the fundamentals of freedom of speech in the structure of cultural rights primarily requires contemplation on the status of these rights in legal system of Islam, Iran and a review of international documents. With respect to the effects of Imam Khomeini’s views on consolidation of the essential rights of the nation, reviewing his approach toward freedom of speech and the basis and criteria of culture in his system of thought will be very helpful in picturing this structure بر اساس کرامت ذاتی انسانی و به اقتضای استقلال فردی وی، آزادی بیان ارزشی ذاتی است. اگرچه حق بر آزادی بیان به‌عنوان یکی از حقوق مدنی و سیاسی در نظام حقوق بشر و مباحث مقرون به دموکراسی شناخته‌شده است، اما با مداقه بر مفهوم وسیع آن مشتمل بر فرآورده­ های مکتوب، کلامی و هنری، به‌عنوان یکی از مؤلفه­ های مؤثر در حقوق فرهنگی، مطرح خواهد بود. بسیاری از حق­ ها و آزادی­ های انسانی یا در مجموعه حق­ های فرهنگی قرار دارند یا برای تحقق صحیح آن­ها به حقوق فرهنگی نیاز است. مسئله اصلی این نوشتار واکاوی نسبت میان آزادی بیان و حقوق فرهنگی است. دستیابی به مبنای حق آزادی بیان در ساختار حقوق فرهنگی نیازمند به مداقه بر جایگاه این حق در نظام حقوقی اسلام، ایران و گذری بر اسناد بین­ المللی است. با توجه به تأثیر دیدگاه­ های امام در تثبیت حقوق اساسی ملت، بررسی رویکرد ایشان در خصوص آزادی بیان و مبنا و ملاک فرهنگ در اندیشه ایشان، در ترسیم این ساختار راه گشا خواهد بود. https://matin.ri-khomeini.ac.ir/article_146964_c0ec28e3f68dc20be7b4f3a8324a3f34.pdf
