The main question is if the contracting parties enter into a transaction with an unlawful motive—but without an explicit sinful intent or prior agreement on it—can the transaction still be deemed valid and binding, and can one rely on the principle of party autonomy? Furthermore, in addition to the legal status (hukm wad'i) of validity or nullity, does the Sacred Lawgiver permit the conclusion of such transactions from a devotional (taklifi) perspective?<br>This research employs a descriptive-analytical method, focusing on the opinions of Imam Khomeini to examine this issue. The findings indicate that Imam Khomeini considers transactions with an unlawful motive in verbal contracts to be forbidden (haram) and void (batil). However, he deems them valid in commutative transactions (mu'atat) that are conducted without formal verbal expression. This view contrasts with the well-known opinion of the majority of jurists, who have issued fatwas upholding the validity (sihhah) of such transactions while considering them reprehensible (makruh). Given the everyday role of transactions in societies, answering this question is of particular importance. <span lang="AR-SA">در فقه، اصل بر صحت و لزوم معاملات است و طرفین بر اساس اصل حاکمیت اراده می‌توانند شرایط و ماهیت معامله را تعیین کنند. پرسش اصلی این است که اگر متعاملین با انگیزه‌ای نامشروع - ولی بدون قصد صریح حرام یا توافق قبلی بر آن - اقدام به معامله نمایند، آیا باز هم می‌توان به صحت و لزوم آن حکم داد و به اصل حاکمیت اراده تمسک کرد؟ همچنین، افزون بر حکم وضعی، آیا شارع مقدس با انعقاد چنین معاملاتی موافقت کرده و ازنظر تکلیفی آن را مجاز می‌داند؟</span><br><span lang="AR-SA">این پژوهش با روش توصیفی-تحلیلی و با محوریت آرای امام خمینی، به بررسی این مسئله می‌پردازد. یافته‌ها نشان می‌دهد که امام خمینی در عقود لفظی، معامله با انگیزه نامشروع را حرام و باطل می‌داند، اما در معاملات معاطاتی (بدون لفظ) قائل به صحت است. در مقابل، دیدگاه مشهور فقها، صحت همراه با کراهت اینگونه معاملات است. با توجه به نقش روزمره معاملات در جوامع، پاسخ به این پرسش از اهمیت ویژه‌ای برخوردار است</span><span dir="LTR">.</span> https://matin.ri-khomeini.ac.ir/article_212531_b31c8b09121c71e933b49ad29afe2e86.pdf
