The ongoing approach in Muslim nations is to keep the<br />children and young adults away from the judiciary system as far as possible.<br />The laws chiefly consider emotional, intellectual and mental maturity<br />irrespective of gender in determining the age for full criminal responsibility.<br />The majority of them, however, have insisted on prohibition of exercising heavy<br />punishments such as capital punishment and life imprisonment for under-eighteen<br />youth. With respect to Imam Khomeini’s religious decrees, where he rules by<br />virtue of the principle of dar’ (prohibition of enforcement of an order due to<br />doubt) we can claim his view is in the same direction with this approach</span> <em>افزایش تدریجی مسئولیت متناسب با میزان ادراک با شاخص قرار دادن سن، از رویکردهای پذیرفته شده جهانی برای تحقق عدالت و نشانۀ عدالت اجتماعی است. در بیشتر کشورهای اسلامی، حداقل سن کودکی یا سن عدم مسئولیّت و حداکثر سن کودکی یا دورة مسئولیّت ناقص کیفری اطفال مشخص شده است. رویکرد جاری، در کشورهای اسلامی دور نگه داشتن کودکان و نوجوانان از نظام قضایی تا جای ممکن است. توجه بیشتر قوانین در تعیین سن مسئولیّت کامل کیفری به بلوغ احساسی، فکری و ذهنی و به‌دور از هر نوع تبعیض جنسیتی است. البته بیشتر آنها در مورد ممنوعیت اعمال مجازات‌های سنگین، مانند اعدام و حبس ابد برای افراد زیر هجده سال، تأکید کرده­اند. با توجه به فتاوی امام خمینی و استناد ایشان به قاعدۀ درء، می­توان ادعا کرد که نظر ایشان همسو با این رویکرد است.  </em> https://matin.ri-khomeini.ac.ir/article_47973_17fafdf83f40c1f65914304d453b6f88.pdf
