This is the presumption of innocence which is accepted in all legal systems including in the Islamic system. On the other hand, one of the important effects of the presumption of innocence is the principle of freedom of the accused during the accusation period or legal proceedings. However, despite the existence of these principles, due the necessity of investigations and security measures, the juridical procedures allow temporary detention as a judicial bail. But, this judicial bail is essentially in contradiction with the principle of freedom and presumption of innocence, for as has been argued in this article, the prime principle is unlawfulness of detention before trial. Therefore, there is a contradiction between temporary detention and its primary fundamentals. The present article is an attempt to prove the contradiction and its exceptions from jurisprudential point of view with special reference to Imam Khomeini’s viewpoints and its contrast with international documents. <em>متهمی که وارد فرآیند کیفری می‌شود تا زمانی‌که مسئولیت کیفری و مجرمیت وی طی یک دادرسی عادلانه اثبات نشود بی</em><em>‌</em><em>گناه فرض می‌شود، این مفهوم اصل برائت است که در همة نظام‌های حقوقی به خصوص در دین مبین اسلام پذیرفته شده است. حال از طرف دیگر یکی از مهم‌ترین آثار اصل برائت اصل آزادی متهم در دوران اتهام است. ولی با وجود این اصول در مواردی به دلیل ضرورت تحقیقات مقدماتی و اقدامات تأمینی، قوانین آیین دادرسی کیفری امکان بازداشت موقت را به عنوان یکی از وثیقه‌های قضایی در نظر گرفته است. اما این قرار وثیقه تعارض ذاتی با اصل آزادی و فرض برائت دارد؛ زیرا همانگونه که در مقالة حاضر اثبات خواهد شد، اصل اولی و مبانی بازداشت پیش از محاکمه، اصل عدم جواز است؛ لذا بین صدور این قرار با مبانی اولیة آن تعارض وجود دارد. در مقاله حاضر بعد از اثبات اصل به بیان تعارض و استثنائات آن از دیدگاه فقه با تأکید بر نظر امام خمینی و تطبیق آن با اسناد بین الملل خواهیم پرداخت.</em> https://matin.ri-khomeini.ac.ir/article_47991_ea180f1ea30b6bc86621e2b4d41d7605.pdf
