Among the important issues in this regard is the responsibility of the Leader towards the consultative viewpoints and decisions of the State Expediency Council. It is not clear whether the Leader is obliged to accept the viewpoints of the Council if his viewpoints are in contradiction with those of the Council. There is no reference to this issue in the Constitution either. The present article is an attempt to study the viewpoints of the jurisprudents as well as those of Imam Khomeini on this issue through a critical-analytical approach. In Imam Khomeini’s viewpoints consultation with the experts aims to find out the truths and discover different aspects of a matter and hence abidance by the viewpoints of the consultants is necessary only when the person who receives the consultation is not enough expert in that field; but, if he enjoys the necessary expertise, he can decide on the issue even if his viewpoint is contrary to that of the majority. <span style="font-family: 'B Zar'; font-size: 10pt; mso-bidi-language: AR-SA; mso-fareast-font-family: Calibri; mso-ansi-language: EN-US; mso-fareast-language: EN-US; mso-ascii-font-family: 'Times New Roman'; mso-hansi-font-family: 'Times New Roman';" lang="AR-SA" dir="RTL">پس از بازنگری قانون اساسی،<br />مشاوره دادن به رهبری به مجمع تشخیص مصلحت نظام واگذار شد. از مباحث مهم در این<br />زمینه مسئولیت رهبر در برابر نظرات مشورتی مجمع و تصمیمات آن است. مشخص نیست در<br />صورتی که نظر رهبر با رأی اکثریت مشاوران مجمع موافق نباشد، آیا پذیرفتن نظرات<br />مجمع الزامی است یا آنکه رهبری می تواند برخلاف نظر اکثریت مجمع تصمیم بگیرد. در<br />قانون اساسی به این مطلب اشاره نشده است. این مقاله با رویکرد تحلیلی و انتقادی به<br />واکاوی دیدگاه های مطرح شده از سوی فقیهان پرداخته است و با مراجعه به آثار امام<br />خمینی، دیدگاه آن بزرگوار را استخراج و مستندات فقهی آن را بیان نموده است. از نظر<br />ایشان مشورت و مراجعه به کارشناس جهت کشف حقایق و اطلاع از جوانب مختلف امر صورت<br />می پذیرد و جنبه طریقی دارد در نتیجه التزام به نظر مشاوران تنها در صورتی ضروری<br />است که مشورت کننده تخصص کافی در مورد مسأله مورد نظر نداشته باشد، اما در صورت<br />دارا بودن تخصص، خود می تواند تصمیم مناسب را هر چند مخالف نظر اکثریت باشد اتخاذ<br />نماید</span> https://matin.ri-khomeini.ac.ir/article_51225_0e1d435f47ab4e50f0cc55ff06738d5c.pdf
