Journal Article 2010 09 07 The notion of guardianship of jurisprudent is the central idea of the Shia jurisprudential-political discourse during the era of Occultation of the twelfth immaculate Imam. Imam Khomeini’s viewpoint in this field is more comprehensive and has its own special functions. Although with the passage of time his viewpoints have undergone some changes, the establishment of the Islamic system based on the Guardianship of Jurisprudent in fact deepened the idea and shed light on its various aspects. The present paper focuses on the viewpoints of Imam Khomeini about the principles of legitimacy of Islamic government; role of the people in its formation, form of the government based on guardianship of jurisprudent and the traditional and rational reasons for the necessity of guardianship of jurisprudent during the era of occultation. Also the characteristics, prerogatives and limitations of the ruling jurisprudent as well as his succession are discussed from the viewpoint of the first Shia jurisprudent, Imam Khomeini, who established the guardianship of jurisprudent. <em>ولایت فقیه نظریه مرکزی گفتمان سیاسی فقهی شیعه در عصر غیبت است. با وجود روایت های مختلف از این نظریه، تبیین حضرت امام خمینی در میان سایر تبیین ها جامعیت و عمق نظری و کارکردی خاص دارد.</em><em>این</em><em>نظریه با اندیشه ایشان آغاز نشده، بلکه توسط ایشان  به تکامل رسیده است. تأملات ایشان هرچند ظاهراً با تحولات و تطوراتی همراه بوده، لیکن گذر زمان و مهم‌تر از آن تأسیس نخستین حکومت  اسلامی مبتنی بر نظریه ولایت فقیه و رهبری این حکومت توسط ایشان  سبب شده تا ابعاد و زوایای مختلف این نظریه را هر چه بیشتر و عمیق‌تر  تبیین نماید.</em> <em>در این نوشته، نخست نظریات ایشان درباره مبانی مشروعیت حکومت اسلامی، جایگاه مردم در آن و شکل حکومت ولایت فقیه بیان می‌گردد و سپس  ادله عقلی و نقلی اثبات ولایت فقیه در عصر غیبت بیان شده و با تبیین  شرایط و صفات، اختیارات و مقیدات ولی فقیه و شیوه جانشینی در این نوع از حکومت به واکاوی دیدگاه های اولین فقیه تاریخ تشیع که ولایت فقیه را به منصه ظهور رسانده است، پرداخته می‌شود.</em> https://matin.ri-khomeini.ac.ir/article_62759_12132e9aeff18cde24cb08b1edef3bf0.pdf
