The question is<br />whether they are among the practical principles or among the signs and ways.<br />The argument of the present paper is that they are among signs. Moreover the<br />rules of departure and transgression are different conceptually and from the<br />viewpoint of their examples. Imam Khomeini maintained that it is irrational to<br />consider them separate from one another. Another question is: whether in the<br />rules of departure and transgression the issue of entry to the next stage is<br />relevant? The late Imam did not consider exist from one stage and entry into<br />another stage valid and did not consider the rule applicable to ablution</span> <em>آیا قاعدة فراغ و قاعدة تجاوز جزو اصول عملیه محسوب می‌شوند یا جزو امارات و طرق هستند؟ پس از بررسی ادله به نظر می‌رسد جزو امارات محسوب می‌شوند. به علاوه، قاعدة فراغ و قاعدة تجاوز از نظر مفهوم و مصداق تفاوت دارند. امام راحل^(س)معتقدند که غیر معقول است این دو قاعده از هم جدا باشند. آیا در قاعده فراغ و قاعدة تجاوز دخول در جزء بعدی موضوعیت دارد؟ امام راحل^(س) خروج از یک جزء و دخول در جزء دیگری را معتبر ندانسته و همچنین قاعده را در مورد وضو جاری نمی‌دانند.</em> https://matin.ri-khomeini.ac.ir/article_65929_a8d3a866ac2f8703fc51569e27bcbd5d.pdf
