Journal Article 2001 03 30 From the viewpoint of Islamic law and jurisprudence, partnership in crime is coextensive with sin. The present article studies the commitment of offence, the material and psychological elements of offence and then sheds light on the conditions for the materialization of partnership in crime. <br />It also discusses the punishment for the partnership in crime in accordance to the article 8 of penal code and Article 1 of the Islamic penal code. At the end of the article some allusions have been made to the Quranic verses as well as traditions, reason and consensus regarding the unlawfulness of partnership in crime. <em>معاونت در جرم در فقه و حقوق اسلامی مساوق معصیت و گناه است. نگارنده در این مقاله به عناصر سه گانة تحقق جرم، عنصر قانونی، عنصر مادی و عنصر روانی پرداخته است و سپس شرایط تحقق معاونت در جرم را به طور مفصل بیان نموده است.</em><br /> <em>همچنین در این مقاله دربارة مجازات معاونت در جرم طبق مادة 8 قانون مجازات عمومی و مادة 1 قانون مجازات اسلامی توضیح داده شده است. در پایان به آیات و روایات وارده، حکم عقل و اجماع مبنی بر حرمت معاونت در جرم و اثم اشاره شده است.</em> https://matin.ri-khomeini.ac.ir/article_66204_5bdd7b3894ae607a4b733f292b710738.pdf
