The Impacts of the Prohibition of the Legislator on the Transaction of Smuggled Goods, With Emphasis on Imam Khomeini’s Viewpoints

Abstract




Due to people’s need to the goods and the prevailing condition of the market, the contracts for dealing and carrying smuggled goods is on the rise. Although the legislator has stipulated some penal punishments for good smuggling, the guarantee for the enforcement of the opposition to the legislated prohibition has not been specified. Hence, the impacts of the prohibition of the legislator on the deal of smuggled goods has been studied in this research. This issue has a precedence in the fundamentals of jurisprudence under the title of “possibility of corruption due to requirements of the prohibition in worships and deals” and different views have been offered by experts. Imam Khomeini and some other jurisprudents believe in the details. Imam Khomeini’s approach to this problem is normative and through his creative method has offered useful solutions that have been ignored by the jurists till date. Using descriptive-analytical method, this article has focused on the following issues: the viewpoints of the scholars of the fundamentals of jurisprudence, the arguments of the lawyers, the articles of law on good smuggling, the wording of the legislator, and the validity or invalidity of the dealing of smuggled goods.
