A Study of the Realm of Lien in Commitments based on Imam Khomeini’s Approach

Abstract
Although the nature and regulations of lien prima facie seems to be clear and evident, a review of the viewpoints of the jurisprudents and lawyers in this field shows that the vagueness of the nature of this right and the ambiguity regarding the conditions for placing it have led to diverse viewpoints by theoreticians. This difference of opinion is consequently observed in judicial procedure as well. While some of the thinkers argue that placing lien is correct only in the cases clearly mentioned in the law, others generalize its realm to all mutual contracts. The differences of opinion do not end by these two viewpoints and some thinkers have expanded the realm of lien to the commitments of the parties to the contract after its dissolution. After reviewing different legal and jurisprudential viewpoints, relying on Imam Khomeini’s viewpoints, the findings of this research show that not only the possibility of placing lien exists in all contractual commitments, but also it can be even applied to all mutual commitments, including those falling out of the contractual commitments. However, the generalization of this decree must be conditioned to certain provisions to prevent its contradiction with public order. By accepting this approach, lien can more than ever draw the attention of the individuals and judges and consequently with the promotion of this private judicial procedure, the volume of legal cases and even penal cases will be reduced.
