A Reappraisal of the Evidence for the Necessity of the "Ability to Deliver the Sold Item" Condition with Emphasis on Imam Khomeini's View

Abstract
The two countervalues (al-'iwadān) in a contract of sale possess specific conditions. "Ability to deliver the sold item" is one of the conditions discussed by Imami jurists under the conditions of the countervalues. However, despite the fact that the vast majority of Imami jurists have mentioned this condition, it appears that the evidence presented for its necessity faces serious challenges. Therefore, given that the validity of a sale is contingent upon observing its conditions and stipulations, a detailed examination of this evidence is of paramount importance to determine whether this condition is based on scriptural evidence (adilla al-naqliyyah) or whether it does not require such evidence and is instead based on the primary principle governing sales. The findings of this descriptive-analytical research indicate that all the presented scriptural evidence is subject to critique, and the necessity of the "ability to deliver" condition can only be attributed to rational and customary evidence (al-adilla al-'aqliyyah wa al-'urfiyyah). Moreover, even if the scriptural evidence is accepted, it is merely of an indicative nature (al-irshādiyyah).
