Abstract
The issue of the responsibilities of the physicians have been the matter of debate since long ago and different views have been offered by the Jurisprudents and lawyers in this regard. The aim of the present article is to deal with opposing views with special reference to Imam Khomeini is views and find out a logical solution to be compatible with the requirements of time and society and protect the rights and interests of the patients and physicians. Therefore, first the concept and conditions of the realization of the responsibilities of a physician was treated then the civil and penal responsibilities of the physicians in Islamic penal code was explored and finally Imam Khomeini and other Jurisprudent's views was studied
