Abstract
According to the articles 946, 946 and 948 of the Civil Code of Iran, which is based on the later Imamiya decrees, wife is not entitled to inherit land from her husband, rather she inherits buildings and trees of the land in accordance to her share. It is in fact against justice and fairness and is against the letter of the Quran. Therefore it is necessary to review and reform it.
The author has critically studied the viewpoints of Immamiya jurisprudents and showed that in Islamic Sharia and on the basis of the Quranic text and traditions of the infallible Imams, wife inherits as much as one-forth or one-eighth of the total inheritance left by her diseased husband.
