Deprivation of a Woman from Shared Residence During the 'Iddah Period as a Mechanism to Counteract Breach of Loyalty: An Approach Based on Imam Khomeini's Views

Abstract
Among the rulings of revocable divorce (alāq rij'ī) are the woman's right to reside in the marital home and the prohibition of her eviction by the former husband, except in the case of fāḥishah mubayyinah (manifest indecency), the definite instance of which is the commission of an illicit relationship (adultery) ــ considered the most evident example of a woman's breach of loyalty. Despite the Quran's explicit stipulation of the revocably divorced woman's right to residence and the aforementioned exception, Iran's Civil Code and Family Protection Law have neglected to precisely clarify the relationship between "permissibility of eviction" and "breach of loyalty" during this period, and have not provided a clear enforcement mechanism for it. Employing a descriptive-analytical method and relying on library-based sources, this research seeks to explain the jurisprudential relationship between the permissibility of evicting a revocably divorced woman from the shared residence and her breach of loyalty through the commission of adultery, based on Imam Khomeini's viewpoints. The research findings indicate that loyalty to the marriage contract, although obligatory under the Quranic injunction "O fulfill your contracts" (Awfū bi al-'uqūd), its instances are contingent upon custom ('urf), and during a revocable 'iddah, due to the continuation of the marital bond, this duty remains in effect. Since the philosophy behind the revocably divorced woman's residence in the marital home until the end of the 'iddah is to provide an opportunity for the spouses to repair their marital relationship and facilitate the husband's return to shared life, the wife's adultery constitutes a clear instance of fāḥishah mubayyinah and breach of loyalty. Consequently, the ruling permitting the eviction of the revocably divorced woman from the shared residence is regarded as a civil enforcement mechanism to prevent her breach of loyalty. This approach, grounded in Imam Khomeini's jurisprudential perspective on defining fāḥishah mubayyinah and elucidating its effects on the right of residence, can serve as a model for revising provisions related to family law and formulating effective enforcement mechanisms in this area.
