An Examination of Imam Khomeini’s Approach to the Scope of Detaining the Convicted Person Until the Minority of a Juvenile Wali al-Dam Ends

Abstract
One of the branches of the discussion on the enforcement of qiṣāṣ concerns the situation in which the walī al-dam is a minor. Jurists differ over whether qiṣāṣ may be enforced when the walī al-dam is underage. Imam Khomeini belongs to the latter group, holding that if the walī al-dam is a minor, enforcement should be deferred until the individual reaches puberty and personally makes the appropriate decision. In this context, an important question arises: should the convicted person be imprisoned until the walī al-dam reaches puberty?
Using a descriptive–analytical method and relying on library-based sources, the present study examines juristic views—particularly Imam Khomeini’s position—on this question. The findings indicate that he affirms the necessity of waiting until the juvenile walī al-dam attains puberty; however, he rejects the imprisonment of the convicted person. Only where necessity exists—specifically when the remaining time until puberty is short and there is a risk of the convicted person’s escape—does he consider detention permissible.
