The Non-Authoritativeness of Sensory Knowledge Acquired by Authorized Judges in Divine Penal Cases: Emphasis on Imam Khomeini's Opinions

Abstract
In judicial jurisprudence, the validity and scope of a judge's knowledge are critical issues, particularly given the classification of judicial knowledge and legal claims. This subject has grown more complex in contemporary times with the emergence of the "Authorized Judge" concept and ambiguities in relevant laws.
This paper examines the validity of sensory knowledge acquired by authorized judges in cases involving crimes against divinity, focusing on the principles and viewpoints of Imam Khomeini (RA). The study begins by analyzing sensory perception from a logical perspective and assessing its potential validation under Islamic law. It then evaluates the extent of sensory perception's validity through intellectual reasoning, identifying the central axis in the debate over its authoritativeness.
The research presents evidence against the validity of sensory knowledge in criminal matters, clarifies Imam Khomeini's stance on the issue and addresses ambiguities in relevant legal provisions. The findings reinforce the conclusion that neither mujtahids nor authorized judges may rely on personal sensory perceptions in divine penal cases.
